JELENA NASTASIĆ PR AMARES OFFICIAL, with registered seat in Belgrade (Savski Venac), at Slavka Ćuruvije Street No. 25, Identification Number: 67314972, Tax Identification Number: 114088117 (hereinafter referred to as “Amares”), in the course of its business activities, processes personal data in accordance with the Law on Personal Data Protection and all other relevant regulations governing this legal matter.

Data Controller

Amares is the Data Controller of personal data, in accordance with the provisions of the Law on Personal Data Protection and other regulations governing this legal matter. Amares, as the Data Controller, determines the purpose and manner of processing personal data and is responsible for the storage and use of personal data in written and/or electronic form.

Data Processor

In its business operations, Amares may process personal data on behalf of the Data Controller, in accordance with its written instructions, in which case it acts as a Data Processor.

Personal Data Collected by Amares

The personal data collected by Amares primarily depend on the type of service we provide to customers, users, and clients, the intentions of these individuals to use our services, the types of contracts we enter into with our clients, as well as the intention of customers to exercise their rights based on legal and regulatory provisions on data protection. Primarily, this includes data without which we cannot fulfill our contractual obligations, and it includes at least:

  • Basic personal data (name and surname);
  • Basic contact information (address, phone number, email address);
  • Data related to the use of the website located at the domain;
  • Data necessary for creating a user account on the webshop located at the domain (name, surname, email, contact phone number);
  • Data related to the use of the Amares online store (webshop);
  • Data necessary for the delivery of purchased goods (name, surname, phone number, address, and email);
  • Other personal data necessary to fulfill the client’s rights based on legal provisions on consumer protection.

Collection and Use of Personal Data

Amares processes personal data for the purpose of realizing the sales relationship for products from its own offer, for fulfilling legal and regulatory obligations, as well as for the purpose of achieving its legitimate interests in lawful business operations. If required by relevant legal regulations, for certain reasons, we will request explicit consent from the individuals whose data is processed (you).

The reasons why Amares processes personal data for the purpose of entering into and fulfilling contractual obligations are:

  • Administration of the contractual relationship;
  • Management and handling of complaints;
  • Delivery of purchased goods;
  • Other legal obligations arising from Amares’ business operations.

The reasons why we process your personal data based on our legitimate business interests are:

Processing of Personal Data

Personal data that will be processed by the data processors listed in the chapter Access to Personal Data, whose responsibility and obligation for data protection and confidentiality are defined by the contractual relationship and in accordance with all technical and organizational measures and legal regulations governing the protection of personal data.

Personal data collected by Amares for the purposes stated in the chapter Collection and Use of Personal Data will not be accessible to anyone without authorization from Amares.

Terms of processing personal data for the provision of delivery and return service

For the purpose of providing delivery and return service, Amares collects the following data:

  • Name and surname
  • Delivery or pickup address
  • Phone number
  • Email address

Amares may provide this information to business partners – courier service providers, for the purpose of fulfilling the contracted services. Partners providing services are authorized by Amares to process customers’ personal data solely for the purpose of performing the contracted services.

Exercising Rights

In cases provided for by law, individuals whose personal data is processed by Amares have the following rights:

  • The right to information about the processing of personal data;
  • The right to withdraw consent at any time (withdrawal of consent), if Amares processes personal data with given consent;
  • The right to correction and/or supplementation of already provided personal data;
  • The right to deletion of personal data when they are no longer necessary for the purpose for which they were given;
  • The right to lodge a complaint either directly to Amares or to the competent state authority.

The individual whose personal data Amares processes is obliged to submit the request personally, ensuring that authorized persons of Amares can identify the requester.

Right to Lodge a Complaint with the Supervisory Authority

In addition to the complaint that the individual whose data is processed can file directly with Amares, a complaint regarding the processing of personal data can also be submitted to the Office of the Commissioner for Information of Public Importance and Personal Data Protection, at the address Bulevar kralja Aleksandra 15, 11000 Belgrade, Serbia, via email, or by phone at 011/3408-900.

Data Retention

The retention period for personal data depends on the purpose for which Amares processes them. For example, data collected for sending newsletters is kept as long as the individual is on the newsletter list, or until the consent is withdrawn. Personal data of individuals who have created a user account on the Amares website is processed until the user account is deactivated. Personal data collected for the purpose of concluding and executing contracts is processed until the contractual obligations are fulfilled. Data collected for processing based on legal grounds is retained in accordance with the time limits set by the relevant laws.
